Small town fisherman harpooned on federal charges for catch that’s legal in other states: lawyer

The 63-year-old captain of a Montauk, New York, fishing trawler has been convicted of federal conspiracy and fraud charges for violating local fishing rules that his lawyers say are outdated, wasteful and wouldn’t be a crime in other states.

A federal jury found Christopher Winkler, who owns the 45-foot trawler named New Age that is based on Long Island’s East End, guilty of five counts last week – two each of mail fraud and obstruction of justice and one more for criminal conspiracy for an overfishing plot that racked up nearly $1 million in proceeds.

The problem is, according to his defense, if Winkler had caught the fish in neighboring New Jersey, there likely wouldn’t have been a crime at all.

“The principal culprits here … are the antiquated fish landing quotas, particularly those for fluke that haven’t changed in some 30 years, which cheat New York fishermen out of their livelihoods even as New York’s fluke population has been increasing,” said Richard Levitt, who is one of Winkler’s attorneys.

For now, the defense is evaluating whether to file post-trial motions and planning to appeal once a sentence is handed down.

“If Mr. Winkler had caught and landed the same fish in New Jersey, where the landing limits inexplicably are often as much as 10 times those in New York, there likely would not have been a prosecution,” Levitt said. “As it is, New York fishermen, if they catch above their trip limits, are supposed to throw the fish back into the water even though these fish are dead and, therefore, wasted.”

In other countries, he said, excess catch can be donated to food banks or for agricultural uses.

“There is nothing at all rational about this system, but Mr. Winkler and other Long Island fishermen are easy scapegoats for this regulatory insanity,” Levitt said.

The Department of Justice disagrees, saying in a statement that New York’s fishing regulations were designed in a partnership between state environmental officials and the National Oceanic and Atmospheric Administration (NOAA) to “ensure a long-term, sustainable population.”

An 18-page federal indictment accuses Winkler of violating quotas on hundreds of fishing trips between 2014 and 2017, falsifying documents, and conspiring with the fish dealer, Gosman’s, to cover it up. The plot allegedly earned more than $750,000 in proceeds on about 200,000 pounds of over-limit summer flounder, also known as fluke, and $85,000 on 20,000 pounds of excess black sea bass.

On one occasion, Winkler allegedly dumped overharvested fish overboard as a Coast Guard vessel approached his trawler.

According to the indictment, both commercial fishermen and licensed dealers must file reports on a weekly basis with NOAA about their hauls.

Cousins Bryan and Asa Gosman of Bob Gosman Co. Inc. pleaded guilty in 2021 for their roles in the plot, in which prosecutors said they provided false dealer records to align with Winkler’s filings and helped the captain avoid detection.

They bought the over-quota fish from Winkler wholesale and offloaded the haul from there, according to authorities.

“Fluke and black sea bass play a vital part in our marine ecosystem and quotas are designed to prevent overfishing and stabilize populations for the public good,” Assistant Attorney General Todd Kim said in a statement.

Winkler’s conviction is the latest in an ongoing series of legal disputes between American fishermen and the federal government.

In June, commercial captains from Louisiana and Mississippi sued the Biden administration, alleging that some federal fishing regulations are unconstitutional. Kim was involved in that case as well, court documents show, arguing against the plaintiff claims.

The House continues to stand still as Republicans scramble to elect a new speaker. 

House Majority Leader Steve Scalise, R-La., spent days struggling to increase his support among Republicans after winning the initial GOP nomination — but ultimately bowed out of the race late Thursday.

The House GOP is expected to meet around 10 a.m. Friday to discuss conference rules, where some in the conference said they hoped to be able to work toward a consensus for the next speaker candidate. 

WHO COULD BE REPUBLICANS’ NEXT SPEAKER CANDIDATE AFTER SCALISE BOWED OUT?

But it’s unclear how long it will take. One Republican, freshman Rep. Max Miller of Ohio, indicated that he thought it might stretch into the weekend. 

“I am incredibly hopeful that we’re going to find somebody very soon with 217 by the end of this weekend,” Miller told reporters Thursday night.

The Republicans met on Thursday behind closed doors to continue discussions and negotiations as several holdout party members say they are not behind Scalise.

Negotiations continued late Thursday after the House held a bipartisan prayer vigil for the victims of Hamas’ surprise terror attack and assault on Israel.

During the second conference meeting, Scalise told his colleagues that he would withdraw himself from the speaker race.

The next likely speaker nominee could be House Judiciary Committee chairman Jim Jordan, R-Ohio, who was Scalise’s rival in the speaker race.

GOP lawmakers have begun to weigh in on their support for Jordan, with some backing the Ohio congressman — but even he might have trouble getting to 217 votes among Republicans.

Jordan needs 217 votes to become House speaker, but with the conference rapidly dividing on his potential candidacy he will need to shore up support to meet that number.

“We need to elect a speaker,” Rep. Andy Barr, R-Ky., said Thursday night. “I supported Steve Scalise Scalise, but if Jim Jordan wants to try to get the 217 I’m going to support him. Because we need to get this process completed and start doing the business of the American people again.”

Jordan, however, did not comment when asked Thursday night whether he would run for speaker again. “Any type of announcement about what may or may not happen I think is best done tomorrow,” he said.

Some in the GOP caucus have pushed to meet until a the speaker issue is settled.

Tennessee GOP Rep. Andy Ogles sent around a dear colleague letter Thursday afternoon calling for Republicans to “lock the door” at the conference meeting and keep going until a speaker is picked — even if it means sacrificing the weekend.

With no clear speaker nominee in sight for the House GOP, it is unclear when the House would actually hold a vote to determine the new speaker.

“We don’t have a Paul Ryan,” said one senior House Republican, referring to former House Speaker Paul Ryan, who salvaged Republicans after former House Speaker John Boehner resigned unexpectedly in 2015.

Mexico rejects Biden’s request to build migrant processing centers for now

Mexican President Andres Manuel Lopez Obrador says that he has rejected a Biden administration request to set up migrant processing centers in Mexico, where migrants could apply for U.S. work and refugee visas.

“We have been looking at setting up sites in Mexico, because they [the United States] have asked for it,” Lopez Obrador said, according to the Associated Press. “We have not accepted it, first we want to talk to the presidents.”

He was referring to the leaders of 11 countries along the migration routes in the Hemisphere — including Ecuador, Venezuela, Colombia, Guatemala, Haiti and Cuba. They will meet later this month. He did not rule out building the centers in the future, but reportedly said that he would prefer to have centers in countries that are the sources of migration. However, Mexico is a key source of migration to the U.S.

The Biden administration announced earlier this year the establishment of migrant processing centers as part of its efforts to expand “lawful migration pathways.” It marks a key plank of the administration’s plan to tackle the ongoing border crisis, which the administration has noted is Hemisphere-wide.

‘This is a hemispheric challenge that demands hemispheric solutions,” DHS Secretary Alejandro Mayorkas said at a press conference in April. “Working with our neighbors in the region, we can and will reduce the number of migrants who reach our southern border.”

MIGRANT NUMBERS HIT HIGHEST EVER RECORDED IN ONE MONTH: SOURCES

The processing centers, one of which has already been established in Guatemala, allows for migrants to be screened to see if they are eligible for refugee status, a variety of humanitarian parole programs and even employment access. 

The processing centers will be run by “international organization partners,” officials said in April. The Biden administration has expanded the refugee cap to 125,000 from just 15,000 under the Trump administration. It has also agreed with Mexico to accept refugee referrals of some nationalities from Mexico. In July, the administration said that Mexico would be establishing an “international multipurpose space” to offer “new refugee and labor options for the most vulnerable people who are currently in Mexico.”

Additionally, the administration has parole programs for family reunification and for certain nationalities — including Venezuelans, Nicaraguans, Cubans and Haitians — for which migrants could be eligible. Employment pathways could include temporary worker visas, including temporary seasonal and agricultural visas.

But while the administration has touted a number of areas of cooperation between the U.S. and Mexico, there have also been tensions. Lopez Obrador has bristled at Republican calls for military action to take out drug labs, and has called on Hispanics not to vote for Republicans as a result.

Recently, it has protested Texas’ moves to build a buoy barrier in the Rio Grande, and also increased truck inspections at the border that led to delays.

So far, the crisis is only worsening. Sources told Fox News recently that September’s borders numbers exceed 260,000 encounters — marking a new monthly record.

Duane “Keffe D” Davis is asked by an arresting officer, “So, what they got you for?”

“Biggest case in Vegas history,” Davis says while handcuffed in the back seat of a police cruiser, “Sept. 7, 1996.”

He was referring to the night legendary rapper Tupac Shakur was gunned down in a drive-by shooting.

Davis is the only living suspect who was allegedly in the infamous white Cadillac that pulled up alongside Marion “Suge” Knight’s black BMW, where Shakur sat in the passenger seat, and let off a volley of gunshots.

The exchanged was captured on bodycam and dashcam footage of Davis’ arrest, which were obtained by Fox News Digital in a public records request.

Shakur was killed in the 1996 shooting, which went unsolved until last month when Davis was arrested.

He isn’t the gunman, according to Las Vegas police, which called him the “shot caller” of the South Side Compton Crips street gang that was embroiled in a complex feud with Shakur and his crew that escalated from rap lyrics to brawls and shootings, lead Detective Greg Kading told Fox News Digital.

Davis’ nephew, Orlando Anderson, is believed to be the gunman, but he denied involvement before he was killed in a separate shooting in Compton, California, in 1998.

The other three people in the Cadillac that night have since died, Kading said.

In one bodycam video, an officer approaches Davis, who was walking outside his home, and says, “Hey, Keefe, Metro police. Come over here.”

Davis didn’t resist as the officer leads the self-proclaimed Compton Kingpin to the police car and handcuffed him.

The bodycam of the arrest shows a calm scene with a sunrise in the distance and an otherwise quiet morning on Sept. 29.

Davis told the officers he was going for a walk, which he said is something he frequently does, at the time they arrested him.

Without resistance, Davis went into the police car where he was cuffed and held up against the vehicle as officers searched for potential weapons.

Inside the police car, bodycam video captured the exchange between one of the officers and Davis, and Davis said he’s under arrest for “the biggest case in Vegas history.”

“Recent?” the officer asks.

“Sept. 7, 1996,” Davis responds.

“Oh, no s–t. That’s a long time. That’s a long time away,” the officer says.

“You know what I’m talking about?” Davis says.

They continue to talk about how long it’s been. The conversation dies down after Davis says, “I ain’t worried.”

The conversation between Davis and the officer continued when the cop mentioned the raid on Davis’ home over the summer.

“I was walking around the corner. I just want to walk my walk,” Davis is heard saying in the bodycam video. “I hear a bunch of walkie-talkies in the house behind me, so I peep over the gate, and this SWAT dude peeped over the gate at the same time.”

“They surround my whole house. They yelling, ‘This is Las Vegas Metropolitan Police Department and SWAT team.’ I said, ‘I ain’t do nothing. I was just walking down the street.'”

Davis allegedly orchestrated Shakur’s murder, according to Las Vegas police, after a fight involving Shakur and Anderson in the lobby of the MGM Grand Garden Arena in Las Vegas.

“He (Davis) is not the gunman. He’s the one who [allegedly] secured the gun, brought it into the car and gave the gun to his nephew, Orlando Anderson, who did the shooting,” Kading said in a previous interview with Fox News Digital.

“But since they were all conspiring in the murder, they all acted in concert with one another. They’re all equally guilty.”

Davis is the last remaining suspect who was allegedly in the Cadillac when Shakur was murdered.

He spoke to police with immunity in 2009, according to Kading, who was in the room during the interrogation.

“He began to explain, from his perspective, how [the night of the murder] unfolded, and what he did the night that they shot and killed Tupac,” he said.

Kading said his demeanor during the interrogation was “boisterous” and that he repeatedly told law enforcement, “I’m Keffe D.”

“He’s got this braggadocios type of character. He thinks that he’s a legend in his own mind,” Kading said.

That boisterous bravado continued in a couple documentaries and podcasts, most notably a 2018 documentary called “Unsolved: The Murders of Tupac and the Notorious B.I.G.” in which he said he had been diagnosed with cancer.

He also wrote a tell-all memoir called “Compton Street Legend,” which was among the items confiscated by law enforcement after they raided his home with a search warrant this past summer.

But the immunity that police gave him during the 2009 interrogation didn’t cover public comments, Kading said, which became the biggest break in one of the country’s most notorious cold cases.

“He talked himself into jail,” Kading said.

Shakur was 25 when he died. His fourth solo record, “All Eyez on Me,” was still at the top of the charts with about 5 million copies sold.

Lack of cooperation from witnesses stalled the investigation, and the case has gone unsolved for almost 30 years.

Shakur’s murder was even more eerie – and became legendary – after his lyrics seemed to foreshadow his early death.

“The fast life ain’t everything they told ya. Never get much older, following the tracks of a soulja,” he wrote in his 1991 song “Soulja’s Story.”

Miami mogul uses plane banner to find wife’s stolen purple Rolls-Royce

A Florida businessman took to the skies to hunt down his wife’s rare Rolls-Royce after brazen thieves stole the $250,000 luxury coupe from their garage in broad daylight.

Bob Benyo, 61, the owner of Aerial Banners Inc., was so outraged by the Sept. 21 heist, he sent an airplane over Miami dragging an unusual banner.

“STOLEN PURPLE ROLLS-ROYCE REWARD…,” blared the message followed by Bob’s cellphone number.

It’s insured for more than it’s worth, but that’s not the point. The point is this is exactly why my insurance rates are so high and your rates are so high, and I’m sick of it. I’m done,” he told Fox News Digital.

CELEBRITY JEWELER TARGETED IN HIGH-TECH HEIST; THIEVES CAUGHT ON CAMERA

Minutes after his wife Olga Benyo, 41, and their two young children arrived at their waterfront home, the thieves broke into the garage.

A little after 3 p.m., a neighbor’s security camera recorded two men walking up the driveway, then Olga’s beloved Wraith with chrome rims and white leather interior can be seen driving out.

Sophisticated car thefts have recently plagued the upscale neighborhood, Bob said. 

Detectives believe the burglars cloned the garage remote. The thieves left behind an Aston Martin Vanquish and a 1970 Chevelle.

The Aston’s $1,500 key was missing, and Bob suspects the men first tried to steal the sports car but couldn’t figure out how to turn it on. 

After his wife called in a panic, he reached out to police and rushed home. 

He also got a call from his ex-wife, who said her new husband had just spotted their Wraith speeding north on Biscayne Boulevard and weaving in and out of traffic. 

“I thought immediately, I’m going to fly an airplane with a message offering a $5,000 reward,” he said.

By 5 p.m., one of his planes was in the sky over Miami and Fort Lauderdale. 

“When you own the company you can get those banners in the air really fast,” quipped the businessman, who also sells motorcycles and aircrafts.

The plane flew for two days and more than 300 tips poured in. 

A man called from an anonymous number and said that he’d spotted the Rolls-Royce listed for rent on Telegram. He proposed renting it and returning it for the reward.

Bob agreed, but the jittery thieves backed out. They told the man they decided to ship it to California, where it might be easier to unload.

The investigation had hit a dead end until Bob got a phone call at 11:30 p.m. Sept. 23.

“This girl says ‘I know where your car is. I’m looking at it right now out my window,” he recalled. “She said she didn’t care about the money. She told me, ‘I’m just mad someone broke into your house and stole something special to your wife.’ She meant it. Really meant it. I spoke to her several times, she never once asked for the reward.”

Police arrived on the scene and found the Rolls-Royce sitting in an outdoor parking lot in a rough section of Fort Lauderdale. 

“The area is known for criminals parking stolen cars for a cool-off period to see if there’s a GPS tracker,” Bob said.

Although the car was unscathed, more than $23,000 in valuables were gone, including an $18,000 Hermès purse, a pair of Chanel sunglasses and a Louis Vuitton scarf, according to a police report. 

The burglars, who were driving a silver Mercedes, are believed to be connected to a string of car thefts in Benyo’s neighborhood.

“This is what they do every couple of days,” he said. “The detective told me it’s their shopping mall.”

Olga adores her purple Rolls-Royce and was thrilled to get it back. “Oh my God she was ecstatic. The happiness I saw on her face was more than the day I got her the car,” Bob said.

He bought the Wraith in 2019 as a gift for their wedding anniversary. Olga, who works as an etiquette coach, likes to use the car for client meetings, he added.

“I’m a mechanic, so we’re like yin and yang. I usually have dirt under my nails. You’d never think I’d have a wife that looks like her and teaches etiquette,” he told Fox News Digital. “Sometimes she uses me as an example of what not to do.”

The young woman who called in the tip received the $5,000 reward – even though she didn’t ask for it, Bob said. 

“I’m just so grateful there are still good Samaritans in the world, and she needed the money,” he added. “It was a really uplifting experience.”

Bob said two men have been arrested in connection to the theft, which Fox News wasn’t immediately able to verify.

Graveyard ghouls on the loose after ‘disturbing’ mausoleum raid

Officials in Colorado said they made a “disturbing and awful” discovery of stolen body parts from a cemetery’s mausoleum. 

“It’s disturbing, and it’s awful, and it’s sad, and it’s a felony charge,” a spokesperson for the Jefferson County Sheriff’s Office, Jacki Kelley, told local media. 

Sheriff’s deputies launched an investigation early Wednesday morning after discovering someone broke into a private mausoleum and stole body parts at the Crown Hill Cemetery, the Jefferson County Sheriff’s Office said in a press release. 

“The faceplate had been smashed away and was laying on the ground. The crypt behind that had been accessed, and the casket that was inside was partially pulled out,” Kelley said of the crime.

Authorities said “unknown suspects” gained access to the cemetery the previous night and not only damaged the mausoleum but pulled out the casket, “pried” it open and removed “portions of the body.” 

“It’s so disturbing that someone would take the steps … to unearth someone who has been laid to rest and to do anything to harm the body of somebody who’s gone, and how devastating these can be for families,” Kelley told KUSA. 

The cemetery is located in Wheat Ridge, about 6 miles outside Denver. 

Authorities have not released which body parts were stolen. 

“At this point, there is no clear motive for this disturbing and awful criminal event,” Kelley told Fox News Digital. 

DOZENS OF CHRISTIAN GRAVES TOPPLED, DEFACED IN HISTORIC JERUSALEM CEMETERY: ‘CLEAR HATE CRIME’

The sheriff’s office added the suspect, or multiple suspects, face felony charges, including abuse of a corpse, criminal mischief and third-degree burglary and theft. 

The deceased’s name has not been released to the public, but those laid to rest inside the mausoleum all died in the early 20th century.

Police are trying to locate family members of the deceased. 

“This specific scene today is someone who died actually long ago, and so it’s been difficult to find family,” Kelly told KUSA.

PENNSYLVANIA MAN PLEADS GUILTY IN CASE OF STOLEN HUMAN BODY PARTS FROM HARVARD MEDICAL SCHOOL

Authorities said the suspect only disturbed one of three caskets in the mausoleum. They are calling on the public to come forward with tips. 

The incident comes after a former manager at the Harvard Medical School morgue was indicted this summer for allegedly stealing and selling human body parts. Cedric Lodge is accused of running a scheme from 2018 until earlier this year that involved him allegedly stealing donated body parts, such as heads, brains and bones, and selling them. 

He is accused of allowing some customers to visit the morgue and select which body parts to purchase.

White House silent on Biden official’s pro-Palestine post amid bloodshed in Israel

The White House opted not to respond to a request for comment after a Biden administration communications official’s pro-Palestine social media post resurfaced amid the Middle East crisis.

Tyler Cherry, who is now the Department of the Interior’s principal deputy communications director and senior spokesperson, said in the 2014 post that he was celebrating the end of the “occupation of Palestine.” The post came amid the 2014 Gaza War in which Palestinian forces, led by the radical Iran-backed terrorist group Hamas, launched hundreds of rockets into Israel, sparking a forceful Israeli response that involved airstrikes and a ground invasion.

“Cheersing in bars to ending the occupation of Palestine — no shame and f— your glares #ISupportGaza #FreePalestine,” Cherry said on July 25, 2014, in a post on X, formerly known as Twitter.

The White House, Interior Department and Cherry himself all ignored requests for comment about the post.

The war started on July 8, 2014, when Israel launched Operation Protective Edge which was mainly focused on destroying — via airstrikes and, later, ground troops entering the Gaza Strip — an intricate network of tunnels the Hamas terrorist group used to cross into Israel underground, according to a report from the RAND Arroyo Center.

“While this was a war Israel did not want, it was a war that inadvertently preempted a terrorist massacre inside Israel’s heartland, principally through a network of sophisticated tunnels built deep under the border, and intended to stream hundreds, if not thousands, of dedicated terrorists, many on suicide missions, in the quiet of night, to destinations where they could kill as many innocent people as possible and leave Israel mauled as never before,” Jerusalem Center for Public Affairs stated in its own report.

Overall, according to the United Nations, 72 Israelis died during the war while there more than 2,000 Palestinian deaths, the vast majority of which occurred after Palestine rejected a ceasefire proposed by Israel on July 15, 2014.

While the United Nations and other global groups condemned Israel for the civilian deaths caused by its operations, now-retired U.S. Gen. Martin Dempsey, who served as chairman of U.S. Joint Chiefs of Staff between 2011 and 2015, said after the war that Israel had gone to “extraordinary lengths to limit collateral damage and prevent civilian casualties in the Gaza conflict.”

Meanwhile, Cherry’s post during the 2014 war resurfaced amid the latest conflict between Israel and Palestine. Last weekend, Hamas unleashed a series of coordinated attacks on innocent civilians across Israel, resulting in thousands of deaths.

Overall, the escalating conflict has claimed the lives of at least 2,500 people, including at least 1,000 Israelis and 27 Americans, according to the latest information.

“We have only started striking Hamas,” Israeli Prime Minister Benjamin Netanyahu said in a televised address this week. “What we will do to our enemies in the coming days will reverberate with them for generations.”

Since Tuesday, Israeli warplanes have unleashed an aerial bombardment of downtown Gaza City, and the nation is considering sending its troops on the ground into Palestinian territories.

“The brutality of Hamas — this bloodthirstiness — brings to mind the worst — the worst rampages of ISIS. This is terrorism,” Biden remarked in a speech on Tuesday. “But sadly for the Jewish people, it’s not new.”

“Like every nation in the world, Israel has the right to respond — indeed has a duty to respond — to these vicious attacks. I just got off the phone with — the third call with Prime Minister Netanyahu. And I told him if the United States experienced what Israel is experiencing, our response would be swift, decisive and overwhelming.”

Cherry’s past social media posts attacking police officers as racist and boosting the “Russiagate” conspiracy theory during the Trump administration recently came to light. While the White House declined to comment on those posts, it attacked conservatives for what it characterized as personal attacks on Cherry.

“No one should be targeted simply for being themselves. It is cruel and unacceptable,” a White House spokesperson told The Advocate, an LGBT-focused news outlet, last week. “This is an administration that believes to our core in the principle that out of many we are one — and we are proud that the people who serve in it reflect those values as well.”

“Tyler is an invaluable member of our team who continues to deliver for the Department of Interior and the American people.”

Cherry, who has served at the Interior Department since early 2021, previously worked for President Biden’s presidential campaign, left-wing consulting firm SKDK, and Media Matters for America, a progressive publication.

House Republicans are once again left scrambling for a leader after Majority Leader Steve Scalise, R-La., stepped back from being speaker-designate on Thursday night.

Scalise won a closed-door secret ballot vote to be the House GOP’s new candidate for speaker on Wednesday afternoon. However, it quickly became clear that he did not have the 217 votes needed to win a House-wide vote.

Republicans could begin voting on a new candidate as soon as Thursday, and several names have been floated as possible nominees.

Jordan was the only other formally declared candidate in the House GOP’s race for speaker, netting 99 votes to Scalise’s 113. 

He had dozens more public endorsements than Scalise, however, and despite publicly backing the Louisiana Republican after the first conference vote, several members still said they would vote for him on the House floor.

“My voters are breaking about 87% for Jordan. So we’re doing polling back in the district, and my job is to represent them,” Rep. Eli Crane, R-Ariz., said on Thursday morning. He added that Jordan had not personally dissuaded him from voting in his favor on the House floor.

But Jordan’s reputation as a bomb-thrower has made a significant share of the House GOP’s moderates wary.

Jordan did not immediately reply to Fox News Digital’s question about whether he would renew his speaker bid.

Two lawmakers told Fox News Digital that Emmer, who currently holds the No. 3 leadership spot within the House GOP, had been floating a run for speaker behind the scenes even while publicly backing Scalise.

He’s publicly said he was interested in the majority leader role — which Scalise is now retaining after backing out of the race.

One of the GOP lawmakers said Emmer would have been “whipping votes for our speaker candidate” if he were “running for majority leader.”

Before Scalise stepped back on Thursday, the second GOP lawmaker said Emmer had been “trying to position himself as the fallback” amid concerns over Scalise’s recent cancer diagnosis.

Asked about those claims before Scalise stepped back, Emmer’s spokesperson told Fox News Digital: “Whip Emmer was one of the first people to publicly endorse Leader Scalise’s bid to become Speaker. He is focused on ensuring that happens.” 

They did not immediately respond to a question about his plans following Scalise’s withdrawal.

Rep. Morgan Griffith, R-Va., told Fox News Digital when asked about the possibility of Emmer as a candidate, “I think he would be viable at some point.”

McHenry, chair of the House Financial Services Committee, is serving as interim speaker while a new one is being decided.

He’s distanced himself from the idea of running for the gavel – but reports indicate that some GOP lawmakers are looking to at least extend his tenure by fleshing out the vague boundaries of his role.

Additionally, Fox News learned earlier on Thursday, ahead of Scalise’s announcement, that a few Republicans were exploring ways to temporarily empower McHenry with certain authorities until mid-November, when the current continuing resolution on funding the government is supposed to expire.

Rep. Dan Crenshaw, R-Texas, publicly threw cold water on the idea ahead of Scalise’s ouster on Thursday.

“I’m not going to speculate on Patrick unless Patrick wants to speculate about running. I mean, it’s just not a thing right now,” he told Fox News Digital.

Top Biden aide with close ties to Hunter was first WH staffer to handle classified docs, new timeline reveals

A top aide to President Biden who has close ties to Hunter Biden, even referring to him as a “brother” in emails, was the first person to “take inventory” of Biden’s documents and materials at his think tank, according to a new timeline released by the House Oversight Committee.

House Oversight Committee Chairman James Comer recently pressed the White House on an “incomplete and misleading” timeline he said that they provided his committee with regard to who had searched through the papers at the Washington, D.C., office for the president’s think tank, the Penn Biden Center for Diplomacy and Global Engagement.

Annie Tomasini, a senior Biden aide, had inspected the classified documents on March 18, 2021, two months after Biden had taken office and nearly 20 months before they were said to be found, Comer said.

“President Biden’s team has misled the American people about the series of events related to his mishandling of classified documents,” Comer told Fox News Digital. “Biden’s team told the American people that documents were unexpectedly found in November 2022, but now we know a White House official and close friend of Hunter Biden was tasked with taking inventory of President Biden’s documents and materials in March 2021.”

“Why did the White House and President Biden’s attorney omit this critical piece of information? The Biden White House may have known President Biden had a document problem as early as 2021 and enlisted at least five White House employees to coordinate, organize, move and remove boxes from Penn Biden Center through 2022,” Comer said. “The Oversight Committee will continue to pursue the facts and provide the transparency and accountability that the American people demand.”

Tomasini is not only a senior adviser to Biden but also a close friend of the president’s son. She maintained close relations with Hunter, in some cases referring to him as her “brother,” and often ended her emails with “LY” for “love you,” according to emails dating from 2010 to 2016.

For example, in December 2010, Biden announced that Tomasini was stepping down to take a position with Harvard University. Tomasini kept Hunter clued in on the details of that position before she took it, according to emails on his abandoned laptop, which Fox News Digital has verified.

The month prior, in November 2010, she forwarded information to Hunter about Harvard’s employee benefits and added, “Thanks.”

“Hey – I looked at benefits And they look pretty amazing. Any word on comp?” Hunter responded.

“I’ll keep you posted. Thanks for looking at all the background Hunt,” Tomasini said.

Later that month, Tomasini was offered the job, writing to Hunter, “Director of intergovernmental relations. > 120k ish – may be a little higher.”

Tomasini thanked him and said she would tell his father the news. Months later, Hunter gave a speech at Harvard, but only after he ran the draft by Tomasini first.

Furthermore, President Biden regularly met with his inner circle at the Wilmington, Delaware, home where classified documents have also been discovered. Hunter Biden had stayed at the house during the COVID-19 pandemic.

While the White House said no visitor logs exist for the president’s Wilmington residence, several people have been identified as guests at the house, a previous Fox News Digital review found.

Biden converted the basement of his Wilmington residence into a de facto campaign headquarters in March 2020 at the onset of the pandemic, and he frequently hosted virtual events and would have had to rely on campaign aides to help.

Tomasini and Anthony Bernal, a senior adviser in first lady Jill Biden’s office, “were allowed in regularly” because “neither of them had their own families, which meant they could devote themselves entirely to the Bidens,” according to the book, “Lucky: How Joe Biden Barely Won the Presidency,” by Amie Parnes and Jonathan Allen.

Biden has spent considerable time in Delaware since taking over the presidency. During the visits, Biden stays at his Wilmington or Rehoboth Beach residences and has a full security detail.

After the discovery of classified documents at the Penn Biden Center, questions reignited on the likes of Chinese donations to the University of Pennsylvania, which houses the think tank. Hunter Biden had also discussed the center in emails before its launch, Fox News Digital previously reported

Special Counsel Robert Hur, appointed by Attorney General Merrick Garland, is leading the current probe of Biden’s handling of the classified materials.

The investigation stems from a batch of records from his time as vice president, including a “small number of documents with classified markings,” discovered by the president’s attorneys at the Penn Biden Center in early November 2022.

The documents were found in a locked closet while preparing to vacate office space at the center, which the president used from mid-2017 until he began the 2020 presidential campaign. The National Archives were notified of the finding and took possession of the documents on Nov. 3, 2022.

Biden, meanwhile, recently conducted two “voluntary” interviews with Hur on Sunday and Monday.

“As we have said from the beginning, the President and the White House are cooperating with this investigation, and as it has been appropriate, we have provided relevant updates publicly, being as transparent as we can consistent with protecting and preserving the integrity of the investigation,” said Ian Sams, a spokesperson for the White House Counsel’s Office, the New York Post reported.

The White House did not respond to a Fox News Digital request for comment.

US military needs AI vehicles, weapon systems to be ‘superior’ global force: experts

Retired Army Gen. Mark Milley believes that artificial intelligence will be a critical component of keeping the U.S. military one step ahead of potential adversaries.

“Our military is going to have to change if we are going to continue to be superior to every other military on Earth,” Milley, the former chairman of the Joint Chiefs of Staff, said during an interview with “60 Minutes” this week.

According to Milley, future wars will look drastically different with the seemingly rapid development of AI technology, something the U.S. will have to be prepared for and adopt if they want to win future wars.

US, NOT CHINA, SHOULD TAKE LEAD ON AI

“Artificial intelligence is extremely powerful,” Milley said. “It’s coming at us. I suspect it will be probably optimized for command and control of military operations within maybe 10 to 15 years, max.”

That sentiment is shared by Christopher Alexander, a former Army information warfare operations operator and current chief analytics officer of Pioneer Development Group, who told Fox News Digital that the technology will be useful to military planners in more ways than one.

“AI is crucial for a range of different functions in the military. From autonomous vehicles to intelligence analysis, AI will help make more of existing resources,” Alexander said, adding that such technology will allow “planners and analysts to be freed from more monotonous tasks to focus on higher-order thinking.”

“At the core of all of these capabilities is the ability of AI to expedite the understanding of difficult circumstances and rapidly respond with precision strike capabilities,” Alexander said. “This will transfer from staff processes all the way to the battlefield.”

Milley told “60 Minutes” that one specific area where AI will do this is with the “OODA loop” (observe, orient, decide, act) with military leaders constantly attempting to determine the next course of action to outmaneuver their enemy. In the past, Milley said, such a strategy would have seen Napoleon waking up in the middle of the night to issue orders before the British had morning tea, but in the future, AI will be used to analyze large chunks of information and give suggestions on where and when to move U.S. forces.

“This is a perfect example of where AI and war gaming can intersect to set strategy and tactics,” Phil Siegel, founder of the Center for Advanced Preparedness and Threat Response Simulation, told Fox News Digital. “There are so many options for using AI, from autonomous vehicles to troop and equipment placement, to consumables usage and replenishment, to simply providing input on battle strategy and tactics. Gaming which uses will be most advantageous and have the best payoff will allow the military to invest wisely in the technology.”

Siegel noted that it will be important for the military to hire “solid AI experts” and have solid relationships “with the private sector,” something that would “allow the military to accelerate its capabilities.”

“Everyone is already using AI technologies and will be accelerating their use,” Siegel said. “Our military needs to invest heavily to stay out front.”

Like Siegel, Milley says every country will have access to and use AI technology in military operations, making it critical for the U.S. to stay at the forefront of the changing landscape.

But when asked if such technology could lead to wars becoming more likely, Milley said such implications are something that leaders are still trying to “come to grips with.”

“It could. It actually could,” Milley said. “Artificial intelligence has a huge amount of legal, ethical and moral implications that we’re just beginning to start to come to grips with.”
